Hello Smartists journey companion!
Here I am not addressing you as a user or potential user of Smartists, but rather as a fellow web3 builder.

I know that talking about “Terms of Service” is an unusual move. Apps let know their users about their terms just when they need them to agree for the use of the app.

I am also well aware that Legal Documentation is usually overlooked by users, despite in the real world we all take very much care of our deals, and with who we are dealing with, especially when interesting businesses derive.

Smartists is all about interesting businesses for artists and art-users. Therefore, I think it is actually worth to have a look to our Terms of Service.

Friendly Documentation

Is that even possible?
Our legal advisor and I have tried to write these terms in simple words, avoiding all jargon, for an easy understanding. After all our users are supposed to acknowledge and agree. So I hope we have managed to express all about our services, and also about our commitment to defend fundamental rights like Privacy and Intellectual Property.
At this very moment we are making the last revisions to include the Documentation in the mvp as soon as possible. Such documentation includes:

  • Privacy Policy

  • Terms of Service

  • Confidentiality Agreement (NDA)

  • Smartists Licensing System

Sometime ago we shared here our Privacy Policy.
This time we bring to you our Terms of Service, as they will be included in our MVP a.s.a.p.

Terms of Service

In just a 2-page document, we address the essential points of our deal:

  • Smartists Services. What can Smartists do for you? The Smartists services provide solutions for authors-artists in any field as well as art-users. Our services are Creator-focused, we highly respect the right to Privacy, and we put security first since our users are the owners of valuable assets, so Smartists is built on the Stacks blockchain, and secured by Bitcoin.

  • Your Content, Your Copyrights. What are your and our responsibilities?USERS RETAIN ALL THEIR COPYRIGHTS RELATED TO ANY CONTENT SHOWCASED OR FOR SALE IN THEIR PRIVATE STUDIOS AND GALLERIES.

    Self-managed creators are solely responsible for the content they showcase, sell and license. By using Smartists to mint an NFT, the NFT creator declares to be the copyrights holder, legally entitled to sell and license the Art NFT from their own Private Gallery. We are very fast progressing towards our MVP-2, which will include the possibility of selling NFTs with use-licenses, and we are looking forward to sharing all about it.

But remember that as technology empowers artists and art-users, both artists and art-users need to be aware of their responsibilities. “With great power comes great responsibility!” and yes, at Smartists we intend to help bringing transparent information.
